Funding Criteria
Several key factors are considered in legal funding. These include:
Damages. Has the client suffered significant injury to property, person or reputation?
Liability. It must be reasonably clear that the defendant is liable for causing the damage.
Ability to Pay. The defendant must have the ability to pay damages through insurance or other means.
Contingent Attorney Fee. Your attorney must demonstrate full confidence in the likely success of your case. In contingency fee arrangements your attorney assumes significant risk, in that he/she will risk not being paid if legal action is unsuccessful.
Your Attorney. Your attorney should be in good standing with the General Legal Council of Jamaica and have a track record of success in the timely completion of similar cases to the satisfaction of his/her clients.
